WARRANTY TERMS:

Limited Warranty: NewHome Bath and Mirror, Inc. warrants that any ClearMirror product will perform substantially in accordance with the accompanying written materials and will be free from defects in materials and workmanship under normal use and service for a period of five (5) years from the date of receipt. Any implied warranties on a ClearMirror product are limited to five (5) years.

Customer Remedies: NewHome and its suppliers’ entire liability and your exclusive remedy shall be, at NewHomes’ option, either (a) return of the price paid, or (b) repair or replacement of the product that does not meet this Limited Warranty and which is returned to NewHome with a copy of your receipt or purchase agreement. This Limited Warranty is void if failure of the products has resulted from accident, abuse, or misapplication. Any replacement product will be warranted for the remainder of the original warranty period or sixty (60) days, whichever is longer.

No other warranties: To the maximum extent permitted by applicable law, NewHome and its suppliers disclaim all other warranties, either express or implied, including, but not limited to implied warranties of merchantability and fitness for a particular purpose, with regard to the products, the accompanying written materials, and any accompanying hardware.

No liability for consequential damages: To the maximum extent permitted by applicable law, in no event shall NewHome or its suppliers be liable for any damages whatsoever (including without limitation, special, incidental, consequential, or indirect damages for personal injury, or any financial loss) arising out of the use of or inability to use this product, even if NewHome has been advised of the possibility of such damages. In any case, NewHome and its suppliers’ entire liability under any provision of this agreement shall be limited to the amount actually paid by you for the ClearMirror product. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply in those states. This warranty gives the purchaser specific legal rights, and the purchaser may also have other rights which may vary from state to state.

U.S. Government Restricted Rights: The ClearMirror product and documentation are provided with Restricted Rights. Manufacturer is NewHome Bath and Mirror, Inc., 425 Weir Drive, Woodbury, MN 55125. The laws of the State of Minnesota, U.S.A., govern this warranty.
